Based on President Trump's speech, only the parents of illegalaliens thought an immigration executive order had been issued to prevent their children from receiving U.S. citizenship.
Illegalaliens, or illegal immigrants, typically refer to refugee status applicants who have not yet been recognized for refugee status, DACA status immigrants, and non-conformist immigrants who have not been reported to the U.S. government since their illegal entry.
However, the actual executive order means the following two groups.
"Here are the categories of individuals who were born in the United States but are not in that jurisdiction. If you fall into this category, the benefits of U.S. citizenship will not automatically extend to that individual:
1. Where the individual's mother was in the United States illegally, and the father was not a U.S. citizen or legal permanent resident at the time of the individual's birth. (It is subject to illegal immigrant in the traditional sense)."
The second category, however, is a group that so far refers to "legal immigrants" but is believed to be a short-term stayer. However, most work visas - work visas - have usually been believed to be the process of applying for permanent residency and then naturalizing them as U.S. citizens. The actual provision is
"2. Where the individual's mother was legally in the United States at the time of the individual's birth, but the stay is temporary (e.g., if she visits through a visa waiver program, a student visa, a work visa, a tourist visa, etc.). At the same time, the father was not a U.S. citizen or a legitimate permanent resident at the time of the individual's birth."
Children of immigrant parents who do not have permanent residency cannot obtain U.S. citizenship. The following situations no longer allow their children to become U.S. citizens.
1. the children of an international student couple
2. Children of families staying in the U.S. on H1b or other work visas
3. If you come to the U.S. and give birth on an expedition after receiving a tourist visa or visa waiver program
I'm sure a lot of people have different ideas. Personally, as a scholar, I think it's complicated because the hypothesis that I expected is becoming a reality.
"Isn't legal immigrant okay? Isn't permanent resident okay?"
On January 20th, the life of legal immigrants has changed. Their future plans have been severely disrupted. Many policies are going to make the lives of legal immigrants suffer. I still have a lot of hope that the H1b immigrant population will increase. My expectations are going to be even harder. For now, all H1B immigrant screening procedures have been suspended.
It's the president of immigrant-hating supporters. It's the logic of political power that should be repaid if it's been supported. It interprets that because President Biden came to power in 2020 thanks to DEI-supporting voters, DEI policies were actively enforced in 2021 and experienced a backlash against them.
And I anticipate a policy that will also reduce the rights of permanent residents in the future. Being a citizen of the United States will be a haven to avoid the effects of that policy. Immigration laws have given the president various powers to reduce permanent residents' rights to administrative procedures without the consent of the National Assembly. Immigration courts and immigration agencies operating within the administration can prevent permanent residents from living in the United States without the need for general courts to intervene.
It will be the next four years to witness scenes in which the president's power guaranteed by immigration law can completely change the lives of legal immigrants.
